Refund policy
POSSIBLE RETURN CASES
The product is defective or may have been damaged during transport:
If the product is defective, the user may return it, with Jamonería Cobel covering the shipping costs for both the initial delivery and the return. Jamonería Cobel will then resend the replacement product at no additional cost.
In cases of significant and visible damage to the merchandise packaging during transport, it is very important that the customer notes the incidents on the delivery note to the carrier and informs us via ventas@lajamoneriadecobel.com as soon as possible.
REFUND DUE TO WITHDRAWAL
In accordance with Spanish legislation, the customer has the right of withdrawal, under which they may return the product received if they find that it does not meet their expectations.
This right may be exercised within a maximum period of fourteen calendar days from receipt. Due to the nature of the products sold on this website, the buyer wishing to exercise their right of withdrawal must not open the product, so that it remains suitable for consumption.
If the buyer has opened the product, this right of withdrawal will not apply according to the exclusions contained in article 103 of Royal Legislative Decree 1/2007, of November 16, which approves the Consolidated Text of the General Law for the Defense of Consumers and Users and other complementary laws, modified by article 28 of Law 3/2014, of March 27 in its paragraph e).
The refund will be processed once the condition of the merchandise has been verified and will be issued via the same payment method used for the purchase. In any case, the refund will be issued within a maximum of 14 calendar days from the date the return request is officially received, provided that Jamonería Cobel arranges for the product to be collected. If the buyer returns the product using a shipping company of their choice, the 14-day period will begin counting from the date Jamonería Cobel receives confirmation of shipment or, failing that, from the date the product is received.
Return shipping costs will be borne by the buyer.
To exercise the right of withdrawal, the buyer may do so through the email: info@lajamoneriadecobel.com or through any other legally valid notification mechanism.
This right of withdrawal will not apply according to the exclusions contained in Article 103 of Royal Legislative Decree 1/2007, of November 16, which approves the Consolidated Text of the General Law for the Defense of Consumers and Users and other complementary laws, modified by Article 28 of Law 3/2014, of March 27, in its paragraphs:
- d) "the supply of goods that may deteriorate or expire rapidly" (according to Best Before Date)
- e) "the supply of sealed goods which are not suitable for return for reasons of health protection or hygiene and which have been unsealed after delivery."
GENERAL WARRANTY FOR ALL PRODUCTS
Unless proven otherwise, products will be deemed to conform to the contract provided they meet all the requirements set out below:
-They conform to the description made by the seller and possess the qualities of the product that the seller has presented to the consumer and user on the website.
2.-They are suitable for the uses to which products of the same type are ordinarily put.
3.-They present the usual quality and performance of a product of the same type that the consumer and user can expect, taking into account the nature of the product.
The Consumer Protection Act provides a two-year warranty period from the date of receipt of the product. However, this period may be subject to change depending on the nature of the product itself, when its useful life (Best Before Date) is shorter than the warranty period stipulated by law.
